Rental Agreement
This Rental Agreement ("Agreement") is entered into by and between Parel Holdings, trading as Keep It Kool Refrigerators ("KIK"), and the applicant whose name appears on the application personal information section ("Client"), establishing the terms and conditions for renting a fridge from KIK.
1. Purpose:
This Agreement governs the rental of a fridge from KIK, outlining the obligations of both parties. The Client, by entering into this Agreement, agrees to comply with and be bound by the terms and conditions herein.
2. Validity:
This Agreement is valid from the date entered by the parties and remains in effect until modified or terminated by mutual agreement or as provided herein. Throughout its validity, the Client must adhere to the Terms and Conditions set forth herein.
3. Risk of Loss or Damage:
The Client assumes responsibility for the fridge and accompanying materials during the rental period. KIK will replace or repair the fridge in case of malfunctioning or mechanical damage. However, the Client is liable for the full fair value of the fridge in cases of damage due to unnatural circumstances or theft.
4. Delivery:
KIK provides free delivery of the fridge to the Client's residential or rental address. Delivery occurs once all necessary documentation is in order.
5. Payment Plan:
The Client must provide a suitable date for monthly debit orders at the contract commencement. Unsuccessful debit orders require an immediate deposit, or KIK will debit twice the following month.
6. Early Termination:
The Client may terminate this Agreement with a one-month notice. If the notice is less than one month, the final debit will occur the following month. The Client can terminate the agreement at any time by notice of 1 month; however, this does not apply during the 9th and 10th months of the contract duration. In these months, the full terms, including the monthly payment obligations, shall apply until the completion of the 10- month term. After the completion of the 10-month term, the contract can be terminated by either party with a one-month notice as specified in this clause.
7. Return:
Upon termination, KIK will arrange to repossess the fridge. Before collection, the Client must defrost and dry the refrigerator. Failure to do so will result in a R100 charge.
8. Change of Information:
The Client must promptly notify KIK of any changes to the provided information during the term of this Agreement, including phone numbers and email addresses.
9. Room Change/Moving:
The Client cannot move the refrigerator from the specified residential or rental address without KIK's express consent.
10. Payment Schedule:
All payments are due at month-end unless otherwise agreed upon. The Client can notify KIK if they prefer monthly payments on the 15th or 25th.
11. Proof of Payment:
The Client must send proof of payment via the KIK Whatsapp Business Account each month for accurate record-keeping.
12. Client Death or Unexpected Circumstances:
In the event of the Client's death or unexpected circumstances, the fridge remains KIK's property, and KIK holds the right to collect it from the premises.
13. Client's Obligations and Promises:
- Use the refrigerator solely for its intended purpose.
- Keep the refrigerator clean.
- Refrain from using or placing harmful objects/items.
- Keep the refrigerator closed when not in use.
- Handle the refrigerator properly and refrain from improper movement.
- Do not remove or lose any materials that came with the refrigerator.
14. Breach of Agreement/Contract:
A breach occurs if the Client fails to meet the terms and conditions. In case of a breach, the Client must make necessary payments; otherwise, this Agreement is void, and KIK is entitled to repossess the fridge immediately.
15. Governing Law:
This Agreement is construed and enforced under the laws of South Africa.
16. Acknowledgment:
The Client acknowledges having read and understood the terms and conditions of this Agreement and expresses no objection thereto.
